Arizona's real estate scene is undergoing a significant evolution with the recent introduction of new laws and changes by the National Association of Realtors (NAR), impacting buyers and sellers. These adjustments, coupled with local regulations, reshape how transactions are conducted and underscore the importance of transparency, accountability, and professionalism. The most significant change is the seller's offer of a buyer's agent compensation is no longer allowed to be advertised in any way in the Multiple Listing Service (MLS) listing page for any home on the market.

While most of this has already been in place, we must make the public aware of how Real Estate relationships are supposed to perform.


Enhanced Clarity in Agency Relationships:

Under the NAR guidelines, REALTORS® are mandated to disclose their brokerage relationships upfront, ensuring transparency and understanding for both buyers and sellers. This disclosure fosters trust by clearly delineating who represents the client's interests throughout the transaction process. There is a form your Realtor will guide you through in relation to this.


Strengthened Fiduciary Duties:

REALTORS® representing buyers bear a heightened duty of care and fiduciary responsibility towards their clients. This entails acting solely in the buyer's best interests, providing candid guidance, and disclosing all pertinent information that could impact decision-making. These reinforced obligations guarantee buyers receive unparalleled service and advocacy during their real estate journey.


Formalized Buyer Representation Agreements:

Under the updated laws and NAR guidelines, buyers are now obligated to enter into written Buyer Representation Agreements with their REALTORS®. These agreements outline the terms of the agency relationship and the extent of representation, ensuring clarity and protection for the buyer throughout the home-buying process. In instances where a seller does not offer compensation to a buyer's agent for bringing a buyer to their home, buyers are required to commit to a fee schedule with their agent. This fee schedule outlines the compensation the buyer will pay their agent if the seller does not provide compensation. As a buyer, you can advise your agent whether you want to be shown any homes that do not offer a buyer's agent compensation. That is clearly up to you as a buyer.
